In this policy, "we", "us" and "our" mean Tamara Konopelky and Marty Smayda, who operate this website. We work under the brokerage RE/MAX Real Estate, 200, 10835 124 Street NW, Edmonton, Alberta T5M 0H4. Each RE/MAX office is independently owned and operated.

We handle personal information in line with Alberta's Personal Information Protection Act (PIPA) and Canada's anti-spam legislation (CASL).

We collect personal information only when you send it to us through one of the forms on this website.

• Contact form: your name, email address, phone number, the reason you are getting in touch, your message, and your address if you choose to include it.
• Home evaluation request: your name, email address, phone number, your property address, your answers about the home (its condition, whether the basement is finished, and other features), and any notes you add.
• Referral form: your name, phone number and email address, plus the name, email address, phone number and real estate needs of the person you are referring, and how you know them.

Like most websites, our servers also automatically receive basic technical information when you visit, such as your IP address and browser type. We use this to keep the website secure and to block spam. We do not use it to build a profile of you.

You do not need an account to use this website. We do not collect payment details, government identification numbers or financial account information through this website.

We use your information for the reason you gave it to us, and for purposes a reasonable person would expect:

• to reply to your question or request
• to prepare the online home analysis or in-person home evaluation you asked for
• to follow up on a referral and, where one is earned, to pay the referral fee
• to provide real estate services when you choose to work with us
• to keep the records that real estate professionals are required to keep
• to protect this website against spam and misuse

By submitting a form, you agree to us collecting and using the information in it for the purposes described in this policy. You can withdraw your consent at any time by contacting us. If you do, we may no longer be able to help with your request, and we may need to keep some records where the law requires it.

If you give us another person's details through the referral form, please make sure they know you are doing so and are happy to hear from us. When we contact someone who has been referred, we tell them who referred them. We use their information only to get in touch about their real estate needs.

We never sell your personal information. We share it only in these situations:

Service providers that run this website for us. They may only use your information to provide their service to us.

Our brokerage. RE/MAX Real Estate may have access to information connected with real estate services we provide.

People involved in your transaction. If you ask us to act for you, we share what is needed with the other parties to the transaction, such as other brokerages, lawyers and lenders. We do this with your knowledge.

Where the law requires it. For example, in response to a court order or a request from a regulator.

Zapier, Neon and Clerk are based in the United States, so information they handle for us is stored or processed there. While it is in the United States it is subject to the laws of that country, and may be accessible to its courts, law enforcement and national security authorities.

You can contact us using the details at the end of this policy to ask questions about how our service providers outside Canada handle personal information, or to request written information about our policies and practices for using them.

We do not use advertising cookies or retargeting pixels on this website. We do use one analytics tool, described below.

• Analytics. We use Google Analytics to understand how the website is used: which pages are visited, for how long, on what kind of device, and the approximate region a visit comes from. It sets cookies in your browser and sends this information to Google, which may store it in the United States. It does not tell us who you are, and we do not connect it to the details you send through our forms. You can opt out with Google's browser add-on or by blocking cookies.
• Sign-in service. Our sign-in provider, Clerk, may set essential cookies in your browser. They are used for security and to keep our team signed in to the admin area, not for advertising.
• Videos. Our videos are hosted on YouTube and embedded using its privacy-enhanced mode. YouTube, which is owned by Google, may collect information when you play a video.
• Facebook feed. Our home page displays posts from our Facebook page using Facebook's own plugin. When it loads, Facebook, which is owned by Meta, may receive information such as your IP address. If you are logged in to Facebook, it may connect the visit to your account.
• Tools and links. The home value tool, Nosey Neighbour, the listings search and the Home Locator App are run by other companies and open in a new tab. What you enter there is covered by their privacy policies, not this one.

You can block or delete cookies in your browser settings. The website will still work.

We keep personal information only as long as we need it for the purposes in this policy, or as long as the law and the rules of our profession require. After that we securely delete it or make it anonymous.

Information you send through this website travels over an encrypted connection. Access to it is limited to our team and to the service providers listed above, and our forms are protected against automated spam. No method of storing or sending information is completely secure, but we take reasonable steps to protect yours.

If a privacy breach creates a real risk of significant harm, we will notify the Office of the Information and Privacy Commissioner of Alberta and the people affected, as the law requires.

You can ask us at any time to:

• tell you what personal information we hold about you and how we have used it
• correct information that is wrong or out of date
• delete your information, where we are not required to keep it
• stop contacting you

Contact us using the details at the end of this policy. We will respond as quickly as we can, and generally within 45 days. We may need to confirm your identity first.

If you are not satisfied with our response, you can contact the Office of the Information and Privacy Commissioner of Alberta at oipc.ab.ca.

We may contact you by phone, text or email about your request and related real estate services. Every marketing email we send includes a way to unsubscribe, and you can ask us to stop contacting you at any time.

This website is intended for adults. We do not knowingly collect personal information from anyone under 18. If you believe a child has sent us their information, please contact us and we will delete it.

We may update this policy as our website or the law changes. The date at the top of this page shows when it was last updated. If we make a significant change to how we use your information, we will say so clearly on this website.
